What is restitution of a procedural time limit?
Restitution of a procedural time limit is a legal mechanism that may allow a party to complete a procedural act after the statutory or court-imposed deadline has expired. In Polish legal terminology, this institution is commonly referred to as the restoration of a missed time limit. It can apply, for example, to filing an appeal, submitting objections, responding to a court order, paying a required fee, or presenting a procedural statement.
A missed deadline does not automatically mean that a case is lost. However, restoring a time limit is exceptional and requires the party to demonstrate that the deadline was missed without fault on their part. The court or public authority does not restore a time limit simply because a party overlooked correspondence, misunderstood the rules, or delayed seeking legal advice.
The rules depend on the type of proceedings. Separate provisions apply in civil proceedings, criminal proceedings, administrative proceedings and proceedings before administrative courts. In Poland, the restoration of deadlines is regulated, among others, by the Code of Civil Procedure, the Code of Criminal Procedure, the Code of Administrative Procedure and the Law on Proceedings before Administrative Courts.
What does restitution of a procedural time limit involve?
A request for restitution must usually be submitted to the authority or court before which the missed procedural act was to be performed. The application should identify the missed deadline, explain the circumstances that prevented timely action and show that the delay was not caused by the applicant’s fault.
As a rule, the missed act must be completed together with the request. For example, if a party failed to file an appeal on time, the application for restoration should normally be accompanied by the appeal itself. Filing only an application without completing the omitted act may result in the request being refused.
The applicant should provide evidence supporting the explanation. Depending on the circumstances, this may include medical documentation, confirmation of hospitalisation, travel records, proof of a delivery error, documents showing an unexpected event, or evidence that correspondence was not properly served. The assessment is individual and depends on the facts of the case.
Procedural laws generally provide short time limits for applying for restoration after the obstacle has ceased. For example, Article 169 of the Polish Code of Civil Procedure provides for a one-week period from the moment when the reason for missing the deadline ceased. Comparable short periods may apply under other procedural regimes. The applicable deadline should therefore be verified immediately in the relevant legislation and in the context of the specific case.

Not every difficult circumstance justifies restitution. Courts examine whether the party exercised the level of care reasonably expected in the circumstances. In particular, they may consider whether the party collected correspondence, monitored the case, acted promptly after learning about the missed deadline and took reasonable steps to protect their rights.
