EXTRADITION TO CHINA DEEMED LEGALLY IMPERMISSIBLE

Our law firm successfully defended a Taiwanese citizen detained in Poland pursuant to an extradition request submitted by the authorities of the People’s Republic of China, seeking his surrender for criminal prosecution. The defence argued that his extradition was legally impermissible due to a real risk of violations of his fundamental rights and freedoms, as well as the fact that he had previously been convicted and had served a sentence for an offence related to the basis of the extradition request.

As a result of our lawyers’ actions, including extensive arguments concerning the human rights situation and standards of criminal justice in China, supported by international reports and the case law of the European Court of Human Rights, the Warsaw District Court refused to allow the client’s extradition. The Court found that there were justified grounds to fear violations of the client’s rights and freedoms and that the circumstances of the case did not allow his surrender to China to be considered legally permissible.
